The Protection of Personal Information Act No. 4 of 2013 ("POPIA") has been put into operation incrementally since 2013, with a number of sections of the Act having been implemented in April 2014.


On 1 July 2020, the remainder of POPIA came into effect. Organisations are now forced to be accountable for protecting the privacy of personal information in the workplace and to ensure that it is used in a responsible and ethical manner.

In this regard, POPIA is industry agnostic and affects all organisations, both large and small. Despite the 12-month grace period afforded to organisations, it is critical that you commence the compliance process as soon as possible to avoid the rush and ensure that you do not miss the deadline. Non-compliance after this grace period could result in corporate/brand reputational damage, hefty fines and even prison time.
